1.Introduction – User Agreement.
Our management team welcomes you to e-alouminio.gr. A website where you can get quotes from builders for the cost of a window installation project and then commission a specialist builder/workshop. For each frame installation project, the specific characteristics of which are described and posted by the client, the client receives offers from manufacturers/professionals and freely and voluntarily selects the contractor, i.e. those who will undertake to complete the project. The client/user of the pages and services of the website e-alouminio.gr accepts the following terms of use, which apply to all content, pages, graphics, images, pictures, photographs and files included in the website e-alouminio.gr. Therefore, he/she should carefully read these terms before visiting or using the pages and services of the website e-alouminio.gr. The customer/user is requested to check the content of these pages for possible changes. The continued use of the website e-alouminio.gr even after any changes means the unconditional acceptance of these terms by the client/user.

2. Definitions of concepts.
The following terms are used in different parts of the website and their exact meaning is defined below: This website with an email address of www. e-alouminio.gr Company: The company that operates the above website. Project: The entire installation/replacement of frames, for which requests for bids are submitted at e-alouminio.gr. Offer: The indicative amount required by a window manufacturer/workshop and posted on e-alouminio.gr for the realization of a job. Additional information entered by the manufacturer/workshop through the e-alouminio.gr User’s website is included: A person who logs in to e-alouminio.gr regardless of whether they are a member or not. Member: A user who, in order to receive an offer or offers from e-alouminio.gr, declares his/her details on the special platform. Customer: A user who wishes to receive offers for a frame installation project at e-alouminio.gr Contractor: A prospective professional, who undertakes a frame installation project by agreement with the client.

3. Scope of Application of Terms
3.1 These terms apply to the use of the e-alouminio.gr website in Greece or abroad.
3.2 The Terms are binding only between the user and us. Except where expressly stated, no provision of these terms will be enforceable (third party rights) and these terms do not give rise to any legal sanctions, claims or other benefits or protections between users or in favour of third parties or with a protective effect on third parties.

4. General Provisions
4.1 When using e-alouminio.gr the user must observe and comply with the applicable laws and provisions contained in these terms. This applies in particular to the content of the information posted by members of e-alouminio.gr.
4.2 We expressly draw the attention of users not to use e-alouminio.gr for illegal activities. It is prohibited to post works for the purpose of not paying relevant taxes or other legal payments (e.g. insurance contributions).
4.3 It is prohibited to provide or transfer any information related to personal contact information (hereinafter: “Contact Information”) in any way, other than that provided by e-alouminio.gr.
4.5 Services and products offered by members must not lead or assist in deceiving third parties or be intended to sell stolen or counterfeit goods.
4.6 Services and products offered by members must not infringe intellectual or industrial property rights, trade secrets, as well as proprietary or personality rights.
4.7 It is prohibited for the services and products offered by members to contravene the provisions of Greek and European legislation, including provisions relating to exports, consumer protection, unfair competition, discrimination or misleading advertising.
4.8 Services and products offered by members must not be defamatory, threatening or extortionate.
4.9 Services and products offered by members must not be directed against social minorities, population groups and racial characteristics.
4.10 Services and products offered by members are prohibited from implying or presenting or relating in any way to child pornography.grcontain viruses, trojans, worms, time bombs or cancel bots or any other program code that may cause intentional damage or cause loss of data both on members/visitors’ computers and the system in general, as well as must not lead to loss of resources or services or functions in part or in whole related to our connection providers or other partners.
4.12 In addition to the above, a member or user is prohibited to create or participate in entries of works concerning services or products, the possible sale of which either involves the risk of e-alouminio.grgr’s liability for violation of provisions of domestic or European legislation, or is contrary to the terms of use and rules of operation of e-alouminio.grgr.

5. Purpose and Termination of Membership.
5.1 Access to the public areas of the e-alouminio.gr website (subject to these terms and conditions) is open to any user.
5.2 In each case we provide the e-alouminio.gr based on the form, functions and services as they are on the website. We do not guarantee that the services of e-alouminio.gr will meet the requirements of a user or that access to e-alouminio.gr will be continuous or error-free. The user has no right to the provision or continuity of any particular feature or service, and the Membership Agreement does not authorize a member to access or the continued availability of any particular feature or service. The company has the right to change the content, to temporarily or permanently suspend access or the operation of the website, to introduce new functions and to perform any functions under the specified conditions.
5.3 The announcements produced by our system regarding a window installation project are provided only for the information of the user concerned. Where these communications contain statements of any legal significance, they are addressed to the user concerned.
5.3.1 Where a contract is entered into for the performance of a task using e-alouminio.gr, only the members that constitute the “client” and “contractor” are the parties to the contract for that task.
5.4 For all matters relating to a job, (e.g. regarding payment arrangements, schedules or authorisation claims), the member must in all cases contact the contractor and vice versa.
5.4.1 The work is carried out exclusively between the client and the contractor.
5.4.2 We are not responsible, nor are we obliged, to receive or process complaints against other members or to mediate or resolve disputes between users, unless the complaint relates to the imposition of legal or contractual penalties on us.

6. Register Privacy Policy.
6.1 As stated above, in order for a user to receive an offer or offers for a specific window installation project, the completion of his/her data is required.
6.2 Any information sent to the website, in particular information requested in order for a user to receive a quote or offers for a project, must be given fully and truthfully. In the event of a change in these details, particularly the contact details, the member must inform us accordingly.
6.3 It is not allowed to create more than one membership account for the same natural or legal person.
6.4 Members who wish to use e-alouminio.gr for professional use may be asked by e-alouminio.gr, after registration, to send a copy of their license (to confirm registration) to e-alouminio.gr. The same applies to any other information placed by a member on the e-alouminio.gr website regarding special qualifications, licenses, experience, membership and similar information that must be verified by sending relevant documentation to us (e.g. diploma). If possible the documents should be sent all at once. If they are not sent, we reserve the right, in the event that our request is not met, not to activate the member or to delete the member.
6.5 Regardless of the user’s obligations, we do not guarantee that the information placed by members, such as information relating to identity, address, qualifications, offers or solvency, is correct. Therefore, it is the responsibility of each member to check the relevant data of other users. The company will examine any information for inaccurate data. If verified, we will request information from the relevant member to correct such information, or block or delete such information.

7. General Rules for the Tender Procedure.
7.1 A project registered by a client on e-alouminio.gr must not be commissioned in any other way, other than “Commissioning”.
7.2 Members may submit their bids only through the e-alouminio.gr website.
7.3 Once an offer has been accepted by the client for a project registered on e-alouminio.gr, the parties – client and contractor – must contact each other immediately to complete the project.

8. Project Posting Conditions and Prohibited Project Listings.
8.1 The registration of a project does not constitute a commitment between the client and the bidding professionals.
8.2 The registration of works that violate the law and the rights of third parties is prohibited.

9. General Rules for Submission of Tenders.
9.1 Tenders for the realization of a frame installation project registered on e-alouminio.gr must be submitted only through e-alouminio.gr, using the respective functions provided for this purpose.
9.2 The submission of false offers that reduce or avoid the fees for the use is prohibited.
9.3 The Candidate Professional remains bound by any of his/her bids, which are registered on e-alouminio.gr unless they have been withdrawn in accordance with paragraph

10. Withdrawal and Processing of registered Tenders.
10.1 Registered offers can be withdrawn or modified at any time after processing by the user, using the respective functions provided for this purpose by us, as long as the project has not been awarded. However, if the project has already been assigned to a crew/professional, the contractor’s consent and explicit consent is required, in which he will accept the user’s changes.

11. Tender Submission Procedure, Tender Submission Period and Project Cancellation.
11.1 An offer from a candidate professional is accepted by the Project Assignment.
To award a project, the client accepts one of the tenders submitted.

12. Fees for use / Terms of Payment.
12.1 Fees will be charged for the use ONLY to professionals-workshops (NOT to customers seeking offers), according to the price list of e-alouminio.gr. The member (professional-associate) who uses the services charged by e-alouminio.gr is obliged to pay these user fees. The fee schedule may include additional arrangements. Project registration in any case is FREE.
12.2 User fees are the consideration for the use of the services charged by e-alouminio.gr. We do not guarantee the quality of the services offered by the contractors, regardless of whether it did not exist from the beginning or ceased to exist after delivery. The responsibility for the suitability of the contractor is solely the responsibility of the customer. The obligation to pay user fees remains in force if an offer registered on e-alouminio.gr is not accepted by the customer.

13. Responsibility for content. Our responsibility.
13.1 The content of the offer area published on e-alouminio.gr is written exclusively by the interested member. The author is solely responsible for the content. We review this content and if it is illegal, defamatory or unauthorized, it will be deleted or access to it will be blocked.
13.2 The format of the e-alouminio.gr services and features from time to time may change. We have no obligation to provide or maintain any special features. There is no guarantee as to the availability of the system. The system may be partially or completely restricted from carrying out regular or extraordinary operations (maintenance or for other reasons, e.g. individual operations). Staging.e-alouminio.gr is exempt from any liability for the consequences of limited availability for any reason. It does not assume any liability for any consequences of limited availability for offers that have been made, for offers that cannot be made during this period.
13.3 e-alouminio.gr will conduct continuous and unannounced monitoring of compliance with the terms.
13.4 We shall not be liable to the User for any loss, damage, costs, expenses, costs or other claims for compensation arising from any information or instructions provided by Members that are either incomplete, incorrect or inaccurate.
13.5 We shall not be liable to the User for any delay in performance, or any failure to perform our obligations if the delay or failure is due to: Acts of God or war or terrorism or failure of power or the provision of internet services or any other cause beyond our control.
13.6 We shall not be liable to the user for any unforeseen loss or damage arising.
13.7 We will not be liable for any personal injury or death caused by negligence or misrepresentation by users.
13.8 The following provisions of the paragraph set out the entire financial liability of a candidate professional (including any liability for the acts or omissions of its employees, agents and sub-contractors) in respect of:
13.8.1 Any breach of these terms and conditions
13.8.2 Any use of the functions of e-alouminio.gr or any part of them
13.8.3 Any representation, statement or act or omission in tort (including negligence) arising out of or in connection with these Terms.
13.13 Under Article 13 we will not be liable for:
13.13.1 Loss of profits or
13.13.2 Loss of work or
13.13.3 Exhaustion of goodwill and/or similar losses or
13.13.4 Failure to achieve the expected savings or
13.13.5 Loss of goods or materials or
13.13.6 Cancellation of the contract or
13.13.7 Loss due to technical problems of data or information; or
13.13.8 Any special, indirect, consequential or net economic losses, damages, costs or expenses.

14. Obligations of a prospective professional (frame manufacturer).
14.1. It is noted that the prospective professionals who post their offer or offers for a project through e-alouminio.gr are required to be based and produce their products (frame systems) within the Greek territory.
14.2. The frame systems that will be installed in each project are expressly agreed to be CE certified.
The management company of e-alouminio.gr expressly states that it is not responsible for the quality, the properties, the individual characteristics of the frames, for any legal or actual defects, as well as for the time and manner of delivery / placement of these to customers. The manufacturer is solely responsible for all the above.

15. Changes/periodic changes.
The company reserves the right to expand, update and improve the website and its related products and services, while modifying at its sole discretion the terms of use of the website at any time, without any obligation to do so with the prior consent or notification of users. The user is solely responsible for keeping up to date with the website and its terms and conditions. For this reason, users are recommended to read the terms of use regularly in order to be informed of any changes in their content.
The company reserves the right to change or modify the applicable terms and conditions for the use of the website at any time, without notice to users. Any modification of the terms is effective from the date of its posting on the website. The company reserves the right to terminate, change, suspend or discontinue any individual function of the website, including the availability of services, presentation or description of any product or service without any obligation of prior consent or notification of users.

16. Advertising and sponsors.
The user is aware that advertising and sponsorship messages may be posted on the website. In this context, any complaint regarding the content of advertising material on the website should be forwarded to the direct parties concerned, as the company bears no responsibility in this regard.
In some parts of the website, third party links will be provided for advertising and other purposes. The company has no control over these links, nor does it bear any responsibility for the content of these links. The user who enters through the company’s website to third party websites, assumes exclusively the risk that may arise from them.

17. Applicable law and other terms.
The above terms and conditions, as well as any amendment, change or alteration thereof, are governed and supplemented by Greek law. For any dispute arising from this contract, the Courts of Athens shall have jurisdiction.
Any provision of the above terms becomes contrary to the law, shall automatically cease to be valid and shall be removed from the present, without in any way affecting the validity of the other terms.
No modification of these terms will be considered and will not form part of this Agreement unless it is in writing and incorporated herein.


Use and Sharing of Users’ Personal Data through the FRAMEQS Widget.

Through the Company’s websites and the applications/tools (widgets) provided on them, the frame manufacturers can send offers to prospective customers and issue CE certificates for the frames included in each offer.

Frames manufacturers make use of the Company’s online services (applications, widgets) in order to receive requests for quotations for the installation of frames from potential customers.

FrameQs is a widget that the manufacturer has added to its website or to a platform where it advertises, and which it uses to receive requests for quotes for the installation of frames.

Our Company records personal data for users of the FrameQS widget in case they want to register through the online form and receive a quote for the installation of frames from the respective manufacturer.

In the context of providing the above services, our Company processes personal data in accordance with the provisions of Articles 4(2) and 28 of the GDPR.

The personal data are transmitted / made accessible to the respective frame manufacturer selected by the user in order for the manufacturer to send him an offer for the installation of frames.

The aforementioned recipients – manufacturers of frames are acting as Processors and have provided contractually sufficient assurances for the implementation of appropriate technical and organisational measures in accordance with the requirements of the legislation on the protection of personal data.

The data collected is confidential and manufacturers using the FRAME QS widget agree and commit to follow the rules for the protection of personal data and in particular the provisions of the European Regulation 2016/679 “General Data Protection Regulation” (GDPR)to use the information collected only for the purposes of their dealings with prospective customers.

Legal Basis of the collection by the Company of data of customers – suppliers and potential customers – suppliers is :

– during the pre-contractual stage, namely in case of filling in an electronic contact form or sending an email or telephone contact directly or filling in a printed form, the purpose is to investigate the possibility of a transaction with the Company and the legitimate basis is to serve the legitimate interest of the Company to pursue its commercial purposes by responding to the requested communication to investigate the possibility of a transaction with you.

– In case a transaction with the Company takes place, the data that have been provided to us pre-contractually (as well as those that you will provide to us in the context of our transaction) will be processed for the purpose of implementing the contract and for the Company’s compliance with tax legislation. In this case, the legal basis for the processing is the performance of the contract between us and our compliance with the law (Art. 6(1b) and (1c) of the Personal Data Protection Regulation.

The processing is limited to what is strictly necessary and performed by the Company and the manufacturer in order to ensure the successful implementation of the agreed purposes. Personal data is shared with third parties when it is necessary for the provision of the requested services and products or is imposed on the Company by public authorities as part of our legal obligations.

The Company applies appropriate technical and organisational measures in order to ensure an appropriate level of security.
